Terms of Service

1. Introduction

Welcome to MendMyHome. These Terms of Service ("Terms") govern your use of the MendMyHome website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

MendMyHome provides an online platform that connects homeowners ("Clients") with service providers ("Professionals") for home services (the "Platform"). These Terms constitute a legally binding agreement between you and MendMyHome regarding your use of the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary to keep it accurate, current, and complete. You are solely responsible for safeguarding your password and for all activity that occurs on your account. You agree to notify MendMyHome immediately of any unauthorized use of your account.

4. Service Description

MendMyHome provides a platform for Clients to post job requests and for Professionals to submit proposals for those jobs. MendMyHome does not provide home services directly. MendMyHome is not responsible for the quality, safety, or legality of the services provided by Professionals, nor is it responsible for the accuracy of job descriptions posted by Clients.

MendMyHome is not an employer of any Professional using the Platform. Professionals are independent contractors and are not employees, partners, or agents of MendMyHome.

5. User Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the rights of any third party, including intellectual property rights
• Post or transmit any content that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Collect or store personal data about other users without their consent
• Engage in any activity that could damage, disable, overburden, or impair the Service

6. Payments and Fees

Clients agree to pay the agreed-upon price for services provided by Professionals through the Platform. MendMyHome charges a service fee for the use of the Platform, which is calculated as a percentage of the total job price. The service fee is deducted from the payment to the Professional.

All payments must be made through the Platform. Payments made outside the Platform are a violation of these Terms and may result in termination of your account.

7. Cancellation and Refunds

Cancellation policies and refund procedures are outlined in our Cancellation and Refund Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by MendMyHome and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant MendMyHome a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, MendMyHome shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

10. Indemnification

You agree to defend, indemnify, and hold harmless MendMyHome and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Termination

MendMyHome may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

MendMyHome reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
